Lisa McCurdy, an attorney at Nixon Peabody in San Francisco, has been involved in animal law for about five years. Recently, she participated in a panel discussion with the San Francisco Bar Association focused on animal custody issues. The panel included Bill Shoke, a pet guardian sharing his personal custody experience, and Joyce Tishler, founder and general counsel of the Animal Legal Defense Fund. McCurdy highlighted that pets are considered personal property under the law in all 50 states, despite their significant emotional value to their owners. This legal classification presents challenges for litigants and courts in custody disputes, as the emotional connection people have with animals is often not recognized in a conventional property context.
