Hey everybody. Don Georgevich here with you today. And in this video, Im going to tell you how you can explain to a prospective employer that you were laid off from your last job. I mean, it happens at one time or another in your career. People get laid off. Theres nothing you can do about it. And its even happened to me. Ive been laid off, if you can believe that someone would actually let me go. I know, Im surprised too. But it hurts. Ive been there. Ive been laid off many times in my career. Sometimes, for six or nine months at a stretch with a wife and kids and bills. It gets expensive and its really difficult and its hard to get through. And what I want to do is help you get through this. In the USA, an employee is not required by law to sign a termination form, with or without a lawyer present. If you dont want to sign, then dont sign. An employer is allowed to terminate the employment of an employee without a signature on any form though.
In your signature line, write a salutation like Sincerely, and include the name, title and contact information for the company owner or human resource officer.
Waiving your right to sue a former employer: what it means and when not to sign on the dotted line. If you are fired or laid off, your employer may ask you to sign a release: a contract in which you agree to waive (give up) your right to sue the company in exchange for some benefit, typically severance pay.
Employers use severance agreements to prevent lawsuits, which is why many terminated employees are not offered one. If you do get offered a severance package, it is a sign that your employer thinks you may have a case against them. They want you to waive your rights to sue and are willing to pay for it.
@AttorneyRyan, a labor lawyer, advised viewers: Just because your boss or HR says you have to sign something, that does not make it true. You dont have to sign anything when youre fired. You dont have to sign anything when you quit.
Ending the Meeting End the meeting on the most positive note possible. Wish the employee good luck and shake his or her hand. If you can honestly say something positive about the employees tenure at the company, by all means do so.
No, your employer does not have to give you a reason. But in most cases, if youre fired your employer must give you a written notice of termination. And in some cases, they can fire you without giving you notice.
