Pattern bargaining is a process in labour relations, where a trade union gains a new and superior entitlement from one employer and then uses that agreement as a precedent to demand the same entitlement or a superior one from other employers.
Potential subjects of bargaining fall within three general categories: mandatory, Permissive, and prohibited. Mandatory subjects are those issues about which the parties have a legal obligation to bargain.
Pattern following is probably best known within industries. For example, in the auto industry a target settlement is made by GM or Ford and the United Automobile Workers and then imposed upon the other firms in the industry. The imposition of the pattern may be enforced by threat of a whipsaw strike.
How Collective Bargaining Works Employment conditions. Working conditions and other workplace rules. Base pay, wages, and overtime pay. Work hours and shift length. Holidays, sick leave, and vacation time. Benefits related to issues such as retirement and healthcare23.
They are: mandatory; permissive or voluntary; and, illegal subjects. Mandatory subjects are those that directly impact wages, hours or working conditions (or terms and conditions of employment). These are subjects over which the parties must bargain if a proposal is made by either party.
The main types of collective bargaining include composite bargaining, concessionary bargaining, distributive bargaining, integrative bargaining, and productivity bargaining.
There are three main classification of bargaining topics: mandatory, permissive, and illegal. Wages, health and safety, management rights, work conditions, and benefits fall into the mandatory category. Permissive topics are those that are not required but may be brought up during the process.
Some of these issues, such as the structure of collective bargaining itself, the nature of the obligation to bargain, and the status of work rules (so-called featherbedding), are themselves increasingly subjects of collective bargaining.
