The Chicago Residential Landlord and Tenant Ordinance require landlords to disclose (i) the existence of any building code violations in the past 12 months, (ii) the pendency of any enforcement litigation or compliance board proceeding, and (iii) any notice of intent by either the City of Chicago or any utility
The landlord tenant laws that allow you to break a lease are different from state to state. In many places, you can get out of your lease without penalty for a number of reasons, such as domestic violence, an unsafe environment, or if youve been called up for military service.
In most standard Illinois residential leases, tenants are required to provide 30 days written notice to legally terminate early. The notice period commences at the start of the next rental period after notice is given. Inform your landlord in writing as soon as possible once you decide to leave.
The tenant cannot simply move out with no notice doing so will often result in loss of a security deposit or even a lawsuit for unpaid rent. Terminating a month-to-month lease requires at least 30 days written notice and a termination date that falls at the end of a rental period (usually the end of the month).
Before vacating, the tenant must pay the buy-out fee, typically 2-3 months rent. When considering a buy-out, tenants should read the clause carefully to ensure the duty to pay rent is terminated.
Breaking a lease by executing a buy-out clause, the tenant must typically give the landlord 30 or 60 days notice of intent to execute the clause by filling out a form. Before vacating, the tenant must pay the buy-out fee, typically 2-3 months rent.
The early termination fee is usually equivalent to the rent of two months. A landlord may also require existing renters to provide them with sufficient notice prior to ending the lease term so there is time to find a new tenant, as well.
Its important to note the Chicago Landlord Tenant Ordinance requires landlords to give tenants 30 days written notice if they do not intend to renew their lease. Failure to do so enables a tenant to stay in the property for 60 days after the lease ends under the same terms and conditions as the previous lease.
