Trademarks, unlike patents, can be renewed forever as long as they are being used in commerce. Trademarks are registered with the United States Patent and Trademark Office (USPTO). Federal trademark registration has several benefits: Constructive notice nationwide of the trademark owners claim.
Trade name, trademark and franchise fees all are considered considered Section 197 intangible assets, which are generally deductible over a fifteen year period.
The trademark can be removed from the registry for non-use, as explained below - Not using a registered trademark for a period of five years starting from the date the trademark is registered. If the prescribed renewal fees are not paid, the trademark may be removed from the trademark registry.
If you miss the deadline for filing the Declaration of Use or the Renewal, you can file up to six months late, during the Grace Period. You dont need to ask for an extensionjust go online to .uspto.gov and file the Declaration of Use or Renewal late. The fees will be updated to reflect that you are filing late.
It is possible to claim a trademark once its dead. When a trademark is listed as dead, its previous live status wont bar you from registration. However, you will run into problems of the original owner is still using the trademark or decides to start using it again after a period of time.
A six-month grace period is available. So you have only 6 months if you missed, for example, a Section 8 statement of continued use of the trademark on the goods/services identified in the registration. Additional government fees will apply.
Inability to Enforce Rights: An expired trademark typically means the owner loses the ability to enforce their trademark rights against others using a confusingly similar mark. This situation allows other businesses to use the same or similar mark without facing trademark infringement claims.
Filing a Section 15 declaration makes the trademark owners right to use their mark incontestable under federal law. [2] Incontestability effectively gives the trademark owner a bulletproof vest if they are sued for trademark infringement and is also conclusive evidence that the registered mark is valid.
