In a nutshell, the TM [] and R [] symbols may look similar but they have distinct differences in terms of legal protection, branding value, and usage. The TM symbol is used to indicate ownership of an unregistered trademark, while the R symbol represents a registered trademark.
That is the only time these symbols should appear in writing. This is true in both Canada and the US. The circled R () means registered trademark and the uppercase capitalized TM () means simply trademark. You dont need to use either in your writing unless youre working for the company.
Continuous Non-Use for Three Years If your trade mark is registered for a continuous period of three years and you have not used the trade mark during this time, your trade may be removed from the register.
You do not have to have registered a trademark to use it and many companies will opt to use the TM symbol for new goods or services in advance of and during the application process. The R symbol indicates that this word, phrase, or logo is a registered trademark for the product or service.
Canadian trademark registration is valid for 10 years from the registration date. Trademarks may be renewed within six months before the expiry of the 10-year term. Renewal is still possible within six months after the expiry of the initial term or within a late period of two months from receipt of the official notice.
