After filing, the USPTO will conduct a search and will refuse to register your mark if there is another registered or pending mark similar to yours. Is registration of my mark guaranteed? No. The examining attorney will review the application and may issue refusals based on the Trademark Act of 1946, 15 U.S.C.
The number of times a trademark can be renewed is typically not limited, and in many cases, trademark registrations can be renewed indefinitely, as long as the necessary renewal requirements are met.
A petition for cancellation of a trademark registration may be filed at any time. However, a mark which has been registered for more than five years may only be cancelled on the grounds enumerated in Trademark Act 14.
Unlike patents and copyrights, trademarks do not expire after a set period of time. Trademarks will persist so long as the owner continues to use the trademark. Once the United States Patent and Trademark Office (USPTO), grants a registered trademark, the owner must continue to use the trademark in ordinary commerce.
A federal trademark lasts 10 years from the date of registration, with 10-year renewal terms. Between the fifth and sixth year after the registration date, the registrant must file an affidavit to state that the mark is still in use.
But just because a trademark is dead, doesnt mean that youre totally in the clear to use it. If you run across a DEAD trademark that is identical or similar to yours that doesnt automatically mean it will be available for you to use or register. A trademark will become dead if its abandoned or canceled.
If you dont submit your maintenance documents and fees by the deadline, your registration will expire or be canceled. If that happens, youll need to start the application process over to have nationwide protection for your trademark.
In the United States, a trademark can last forever, so long as it is used in commerce and renewed on time every ten years. To renew a registered trademark, the owner must file the maintenance documents with the United States Patent Trademark Office (USPTO) and meet certain legal requirements.
