7 days off sick or less If youre off work sick for 7 days or less, your employer should not ask for medical evidence that youve been ill. Instead they can ask you to confirm that youve been ill. You can do this by filling in a form yourself when you return to work. This is called self-certification.
Employees that have worked for the same employer for more than 90 days is entitled to take sick leave. Employee can take up to five unpaid sick days per 12 month period. The employee must provide a note to his employer signed by a qualified medical practitioner if on sick leave for 4 consecutive days or more.
Can an employer ask for proof of illness? An employer is entitled to request reasonably sufficient proof that the employee is in fact entitled to Paid Sick Leave. In most cases, this means that an employer can request limited medical evidence (i.e. a doctors note) in support of the employees leave.
Proof of entitlement to sick leave may take many forms. For example, if it is reasonable in the circumstances, it could take the form of a receipt from a drugstore or pharmacy, a medical bracelet from a hospital, or a note from a doctor, nurse practitioner, psychologist, counsellor, or therapist.
Specifically, an employer may require an employee to provide a medical note from a health practitioner such as a doctor, nurse practitioner or psychologist when the employee is taking the leave because of personal illness, injury or medical emergency if it is reasonable in the circumstances.
Currently, the Actrequires employers to provide employees with up-to 5 days of unpaid sick leave per year. The Act does not offer employees job-protection in situations where an employee requires a longer-term leave due to illness beyond these 5 days.
Proof of illness Any employee may be requested to provide a medical certificate for any period of general illness the employee takes. An opted out or excluded employee will be required to provide a medical certificate for any period of general illness lasting twenty (20) work days or more.
You will be granted sick leave with pay when you are unable to perform your duties because of illness or injury, provided your employer is satisfied of your condition and you have the necessary sick leave credits. The advancement of sick leave credits is discretionary.
