The legislature recently adopted Assembly Bill 602, which imposes new requirements on public agencies concerning impact fees on development projects. AB 602 will take effect in two stages. Beginning on January 1, 2022, public agencies will be required to post or link to a written fee schedule on the agencys website.
Traffic impact fees are a one-time payment made by developers to help pay for their fair share of the cost to provide the roads necessary to serve their development. Typically these fees are collected by the appropriate city, county or state agency (usually Caltrans) when permits are issued.
AB 602 focuses on reforming the way cities collect impact fees for new housing such that smaller, more affordable units are not unfairly penalized with higher costs.
California LLC Franchise Tax Every LLC in California must pay an annual franchise tax to maintain its active status and good standing, unless it qualifies for an exception. The tax is a flat fee of $800. Your first tax is due by the 15th day of the fourth month after you form you LLC.
AB602 created new requirements for development impact fees that into effect on January 1, 2022. Specifically, the new law amends Government Code Section 65940.1 and added Section 66016.5 to impose the reporting requirements on cities, counties and special districts.
California Government Code Section 66000, referred to as the Mitigation Fee Act, provides a comprehensive legal framework for ensuring that development impact fees (DIFs) are justified, documented, and used for their intended purpose.
A state law, known as the Mitigation Fee Act from 1987, requires local governments to justify the fees that they impose with detailed studies that show a connection between the fee levied on a new development and the financial impact that development is likely to impose on local infrastructure.
