These photographs should be taken from straight above or straight on at right angles, eliminating potential distance distortions. Each piece of evidence should be photographed with a scale to indicate size and without a scale.
When using scales in photographs, two photographs of each item of evidence must be taken. One photograph must be taken without the scale in view and one photograph taken with the scale. The first photograph will document that the photographer did not cover or block other evidence with the scale.
The main foundational requirement for the admissibility of photographs is authenticity. Authentication of a photograph no longer requires the testimony of the actual photographer. that the photograph is a fair, accurate, true or good depiction of the object or scene at the time in question.
Photographic evidence consists of the images captured by an investigator or forensic photographer at a crime scene that indicate critical information about the crime.
Photographs are considered secondary evidence. 32 The object or view that the photograph is to represent must be admissible. If the subject of the photograph could not be introduced, the picture of it must be excluded.
If it can bend, dont crop it. If it cant bend, cropping is (often) fine. So the knees should not be cropped, but cropping mid-thigh works just fine (see the two images below). The elbows should not be cropped, but cropping just above the elbows looks nice.
