Evidence - Rule 1002 Best Evidence Rule The best evidence rule provides that the original of a writing, recording, or photograph is required to prove the contents thereof.
There are a number of exceptions to the hearsay rule (including present-sense impression, excited utterances, declarations of present state of mind, dying and the business records exceptions), as well as things defined not to be hearsay (admission of a party-opponent, and prior statements of a witness).
The following are not excluded by the hearsay rule, even though the declarant is available as a witness: (1) Present Sense Impression. A statement describing or explaining an event or condition made while the declarant was perceiving the event or condition, or immediately thereafter. (2) Excited Utterance.
Federal Rule of Evidence 803 is a set of rules that provides exceptions to the general rule against hearsay in legal proceedings. Hearsay is an out-of-court statement offered in court to prove the truth of the matter asserted in the statement.
California Code, Evidence Code - EVID 803 The court may, and upon objection shall, exclude testimony in the form of an opinion that is based in whole or in docHub part on matter that is not a proper basis for such an opinion.
Common examples of this exception include statements that reflect the victims fear of the defendant, or the defendants intent to engage in a future act. A statement about a current memory or belief may not be used to prove the fact remembered, but it can be used to show the underlying basis for the memory or belief.
New Hampshire Rule of Evidence 803(10), as amended, adds language to make clear that the lack of a public record exception to the hearsay rule shall apply only if neither the possible source of the information nor other circumstances indicate a lack of trustworthiness.
In summary, Rule 105 helps ensure that evidence is used only for its proper and admissible purpose, preventing the jury from being unduly influenced or prejudiced by information that may be relevant for one issue but not for others in the case.
The best evidence rule only applies when a party seeks to prove the contents of the document sought to be admitted as evidence. The best evidence rule provides that the original documents must be provided as evidence, unless the original is lost, destroyed, or otherwise unobtainable.
The rule is the familiar one requiring production of the original of a document to prove its contents, expanded to include writings, recordings, and photographs, as defined in Rule 1001(1) and (2), supra. Application of the rule requires a resolution of the question whether contents are sought to be proved.
