Generally, for most works created after 1978, protection lasts for the life of the author plus 70 years. For anonymous works, pseudonymous works, or works made for hire, the copyright term is 95 years from the year of first publication or 120 years from creation, whichever comes first.
To write your own copyright notice, you must include some or all four of the following components in this order: The copyright symbol or the word copyright The year the material was published you may include a range of years if your content is regularly updated, and this can be different from the creation date.
The limitations of copyright can include the duration, fair use, resale rights, and more.
Copyright protection generally lasts for 70 years after the death of the author. If the work was a work for hire, then copyright persists for 120 years after creation or 95 years after publication, whichever is shorter. For works created before 1978, the copyright duration rules are complicated.
The Berne Convention stipulates that the duration of the term for copyright protection is the life of the author plus at least 50 years after their death. For some categories of works, the minimum duration is shorter: for example, the minimum term for applied art is 25 years, movies have a minimum term of 50 years.
Unpublished works when the death date of the author is not known may still be copyrighted after 120 years, but certification from the Copyright Office that it has no record to indicate whether the person is living or died less than 70 years before is a complete defense to any action for infringement.
Under current copyright law, beginning in 2049, 1978 and beyond works by creators who died seven decades earlier will expire each year. For example, if a creator were to die in 2002, their works copyright would last through the end of 2072 and enter the public domain on January 1, 2073.
Works published after 1923, but before 1978 are protected for 95 years from the date of publication. If the work was created, but not published, before 1978, the copyright lasts for the life of the author plus 70 years.
