amp;gt;amp;gt; From the Library of Congress in Washington, D.C. amp;gt;amp;gt; Regan Smith: Okay, I think weamp;#39;re waiting for one participant whoamp;#39;s a couple minutes away, but weamp;#39;ll go ahead and start and he can join when he gets here. Welcome to the roundtable discussion for the Copyrights Office study on Section 1201 of the DMCA. Thank you for being here. My name is Regan Smith, Iamp;#39;m Associate General Counsel of the Copyright Office. As you know, the Office is conducting this study in ance with a request from the House Judiciary Committeeamp;#39;s ranking member in response to the Register of Copyrightsamp;#39; Testimony in a 2015 Copyright Review Hearing regarding the impact and the efficacy of Section 1201 and the triennial rulemaking process. If youamp;#39;re hear, youamp;#39;re probably familiar with 1201, but just, I wanted to provide a little bit of background into the statute and how it was enacted. 1201 is part of the DMCA enacted in 1998.

Generally, for most works created after 1978, protection lasts for the life of the author plus 70 years. For anonymous works, pseudonymous works, or works made for hire, the copyright term is 95 years from the year of first publication or 120 years from creation, whichever comes first.
The Berne Convention stipulates that the duration of the term for copyright protection is the life of the author plus at least 50 years after their death. For some categories of works, the minimum duration is shorter: for example, the minimum term for applied art is 25 years, movies have a minimum term of 50 years.
Copyright protection generally lasts for 70 years after the death of the author. If the work was a work for hire, then copyright persists for 120 years after creation or 95 years after publication, whichever is shorter. For works created before 1978, the copyright duration rules are complicated.
Under current copyright law, beginning in 2049, 1978 and beyond works by creators who died seven decades earlier will expire each year. For example, if a creator were to die in 2002, their works copyright would last through the end of 2072 and enter the public domain on January 1, 2073.
There is no maximum or minimum with regard to actual times. In other words, you cannot ever defend an infringement complaint with, but I only used 2 seconds of 17 U.S.C. Section 107 allows for the fair use of copyrighted materials for commentary, educational purposes, critique, news reporting
U.S. copyright law provides copyright owners with the following exclusive rights: Reproduce the work in copies or phonorecords. Prepare derivative works based upon the work. Distribute copies or phonorecords of the work to the public by sale or other transfer of ownership or by rental, lease, or lending.
Works published after 1923, but before 1978 are protected for 95 years from the date of publication. If the work was created, but not published, before 1978, the copyright lasts for the life of the author plus 70 years.
As a general rule, for works created after January 1, 1978, copyright protection lasts for the life of the author plus an additional 70 years.
