Although William Penn had been granted ownership of the area known as Delaware, the residents did not embrace the idea of being Pennsylvanians and relations were t. In 1704, a separate Assembly began governing the Lower Counties of Delaware, paving the way for the areas eventual independence from Pennsylvania.

Starting with the establishment of the proprietary colony of Pennsylvania in 1681, disagreements over borders were born. In 1682, to solve part of the dispute, a 12-mile radius from New Castle was to delineate the northern border of Delaware.
In 1680, Penn asked Charles for more land near his charter to Pennsylvania to give him ocean access, but the duke of York (and future king James II) wanted to keep Penn away from New Castle. The duke wanted a circle of radius of 20 to 30 miles drawn around New Castle, Nathan wrote.
The boundary would be a circular arc of 12-mile radius with the town of New Castle as the center and extending from the Delaware River westward one-third of a circle (120 degrees.)
