A named patent applicant is the legal owner of a patent application or granted patent. This may be an individual or, more commonly, a company, university or other legal entity. An applicant is named as part of the patent application process and is the legal holder of the rights to any resulting granted patent.
The Act does not have dedicated provisions for removing inventors who were named while filing the patent application. However, relying on sections relevant to inventorship, a petition requesting the Controller to remove an inventor who was named at the time of filing the patent application can be filed.
Whenever a mistake of a clerical or typographical nature, or of minor character, which was not the fault of the Patent and Trademark Office, appears in a patent and a showing has been made that such mistake occurred in good faith, the Director may, upon payment of the required fee, issue a certificate of correction, if
Trademarking your name gives you an additional brand and keeps others from using your name. To trademark your name you must meet specific requirements with the U.S. Patent and Trademark Office (USPTO). Learn more about the qualifications for trademarking a personal name and the best types of names to trademark.
The name(s) of all the inventors must be given to the Patent Office, either when filing an application or shortly afterwards. This is true even if the inventors do not own the invention, for example because it belongs to their employer or has been assigned.
If the only change being made in the patent is correction of the inventorship, this can be accomplished by filing a request for a certificate of correction under the provisions of 35 USC 256 and 37 CFR 1.324. See MPEP 1412.04 and MPEP 1481.02.
Patents are only issued for inventions, ornamental designs of goods, or plants, not names. To protect your brand name and logo, you will need to utilize the trademark registration service. Both patents and trademarks are registered with the United States Patent and Trademark Office.
