If you incurred expenses managing the estate, you can deduct those on the estates tax return. These might include costs like attorney or accountant fees or the cost to use a service. The estate can also deduct any executor fees it paid you for the services you provided as personal representative of the estate.
A deed of trust is an agreement between a home buyer and a lender at the closing of a property. The agreement states that the home buyer will repay the home loan and the mortgage lender will hold the propertys legal title until the loan is paid in full.
Non-grantor trusts and estates may deduct certain miscellaneous itemized deductions only to the extent they exceed 2% of adjusted gross income. The stakes are high: If an expense is subject to the 2% floor, the benefit of the deduction will be reduced or eliminated entirely, resulting in a higher income tax bill.
However, the standard deduction available to an estate or trust is zero ( Code Sec. 63(c)(6)(D)). In addition, special rules govern the computation of certain deductions and the allocation of deductions between the beneficiaries and the estate or trust ( 530 538).
Unfortunately, medical and funeral expenses are not irrevocable trust tax deductions on a 1041, so keep that in mind. However, there are ways to take those deductions. For example, you can medical expenses of the decedent paid by the estate on the decedents personal income tax return.
Legal fees for the creation and management of a trust can also be deducted. Legal fees related to the collection and filing of estate taxes are also deductible. These expenses are not personal, but they are associated with income-producing property.
The costs of funeral expenses, including embalming, cremation, casket, hearse, limousines, and floral costs, are deductible. The cost of transporting the body for a funeral is a funeral expense, and so is the cost of transportation of the person accompanying the body.
