Im Jessica Culver. Im a family lawyer with Dummit Fradin. A separation agreement is essentially a contract between you and another party. So in most situations, were talking about a separation agreement which encapsulates all the issues with your spouse incident to your separation, prior to your divorce. So, through a separation agreement, we can handle property division. We can handle spousal support. We can handle other issues that you may not even think you need to handle. But your attorney can identify them when you have that initial consultation, and you explain your situation. A separation agreement can make things much more pleasant. It avoids a trial. It avoids going through the court process. But we can also use a separation agreement for some issues and then go to trial on other issues. So its a great way, if theres any issue that can be resolved with your spouse without the need for court time. Its a great way to do it. You do not have to have a separation agreemen

In most states, you are responsible for all credit card debt incurred in your name in a divorce. You will not be responsible for your spouses credit card debt if it is in their name only. In community property states, if the card originated during the marriage, you are responsible for 50% of the debt.
Unlike with an authorized-user credit card, where you can easily remove yourself from the primary users account, youll need to pay off and close a joint account if you no longer want the card. And because its a joint account, both cardholders will need to agree to closing it.
Do Not Dispose of Any Property or Asset. During separation, you should stay wary of disposing of your physical assets without the prior consent of your spouse. You and your spouse have equal rights regarding the assets you purchased during your marriage.
Generally, either party can unilaterally close the account by contacting the card issuer over the phone or in writing. Once closed, the cards of both joint account holders and any authorized cardholders will be deactivated, and any future attempt to make purchases will be declined.
The bottom line You are generally not responsible for your spouses credit card debt unless you are a co-signer for the card or it is a joint account. However, state laws vary and divorce or the death of your spouse could also impact your liability for this debt.
If the joint credit card is completely paid off, the two parties just need to agree to close the account. But if there is an outstanding balance on the card, the card issuer will most likely require you and your partner to pay it off completely before being able to close the account.
Removing a Joint Account Holder Generally, either party can unilaterally close the account by contacting the card issuer over the phone or in writing. Once closed, the cards of both joint account holders and any authorized cardholders will be deactivated, and any future attempt to make purchases will be declined.
Ultimately, the decision about who should pay the bills during a separation will be based upon the unique relationship of the couple, as well as their financial status. To make the best decision for both of you, consider what each spouse is able and willing to pay during this time.
