For example, a registration will consist of evidence that the general public has identified the colour with your delivery services.
The decision to claim color in a trademark application hinges on brand strategy and long-term business goals. While a color-specific trademark can enhance brand recognition and create a strong visual identity, it also narrows the legal protection to the exact colors claimed.
What is proof of use? Photographs that show the mark on a tag or label affixed to the goods. Hangtags or labels with the mark and the generic name of the actual goods on the tag or label and informational matter that typically appears on a tag or label in use in commerce for these types of goods.
Trademarks are generally protected through registration, following an application filed with the national or regional intellectual property (IP) office. In some countries, trademark rights are also available through use.
You use the registered trademark symbol () to identify a registered trademark. There is some flexibility in how you use any trademark symbol. Still, you typically put the registered trademark symbol () immediately next to the trademark and in the upper right corner for words and the lower right corner for logos.
If your mark is registered in color, you will not be able to change colors when using the mark to sell your goods or services. In other words, a registered trademark in color requires that you use the exact same design mark with the same colors to maintain your registration.
To be eligible for trademark protection, a color must meet four criteria: It must distinguish the product from its competitors. It must be associated with the product through commercial use (secondary meaning). It must not affect product cost or quality (putting competitors at a disadvantage).
Colors cannot be copyrighted. Copyright protects only original creative works such as novels, songs, and paintings. However, colors can be used as trademarks for branding products and services, which only means that a competitor cant legally use the same trademark to brand the same categories of products and services.
