Under Oregon law, all water belongs to the public. With some exceptions, cities, irrigators, businesses, and other water users must obtain a permit or license from the Water Resources Department to use water from any source - whether it is underground, or from lakes or streams.
The applicant must submit an application describing: the current water right; the proposed changes; evidence of water use; land ownership or consent by the landowner; and, in most cases, compliance with local land use plans.
Once established, a water right must be used as provided in the right at least once every five years. With some exceptions established in law, after five consecutive years of non-use, the right is considered forfeited and is subject to cancellation.

Most water rights are obtained in a three-step process. The water user first must apply to the Department for a permit to use water. If a permit is approved, the applicant must construct a water system and begin using water within a certain time frame.
A water right is considered beneficially used when something is planted (such as a crop, pasture, yard, or other landscaping), irrigated, and growing. You may plant and grow anything (except weeds) that is non-native to the Central Oregon area and requires irrigation to thrive and grow.
Under the Public Trust Doctrine​, the public has the right to use the beds and banks of Oregon-owned waterways to the line of ordinary high water. This boundary line is typically where shrubs, trees, and other plants begin to grow. The land above the line of ordinary high water belongs to the adjacent landowner.
Can Oregon water rights be bought and sold? Yes, but generally not easily. Irrigation districts often have bulletin boards of buyers and sellers along each delivery canal. Areas around Central Oregon enjoy groundwater mitigation credits for use of well water in most areas.
