The DOJ brought the largest redlining lawsuit in history in 2023 against Los Angeles-based City National Bank, which was also found to have discriminated against Black and Latino communities over a similar time period, from 2017 to 2020.
Redlining can be defined as a discriminatory practice that consists of the systematic denial of services such as mortgages, insurance loans, and other financial services to residents of certain areas, based on their race or ethnicity.
We can achieve that in several ways, including: Increasing access to down payment assistance. Increasing access to affordable credit. Investing in affordable homeownership. Retargeting the mortgage interest deduction.
When did redlining end? The Fair Housing Act officially outlawed the practice of redlining in 1968.
The Fair Housing Act in 1968 banned discrimination in real estate and mortgage lending, including racially motivated redlining.
The Fair Housing Act (FHAct), which is title VIII of the Civil Rights Act of 1968, as amended (42 USC 3601 et seq.), makes it unlawful for any lender to discriminate in its housing-related lending activities against any person because of race, color, religion, national origin, sex, handicap, or familial status.
The Department has partnered with U.S. Attorneys Offices, federal financial regulatory agencies, including the Consumer Financial Protection Bureau, and state Attorneys General offices to enforce federal fair lending laws that prohibit redlining, including the Fair Housing Act and the Equal Credit Opportunity Act.
Redlining disregards individuals qualifications and creditworthiness to refuse such services, solely based on the residency of those individuals in minority neighborhoods; which were also quite often deemed hazardous or dangerous.
