Representative payees must receive and hold the beneficiarys benefits as directed by SSA. In general, beneficiary and payee funds must not be commingled. One permitted exception is the use of a common checking account for all family members living in the same household who receive benefits.
849.501 Misuse of benefits by a representative payee. (a) It is unlawful for a representative payee to misuse the payments received on behalf of an annuitant. (b) The penalty for a representative payee found to be in violation of paragraph (a) of this section is a fine, imprisonment for not more than 5 years, or both.
If youll no longer be the payee, you must notify us immediately. This is important, because well have to select a new payee as soon as possible. When youre no longer responsible for the beneficiary, you must return any benefits, including interest and any cash you have, to us.
What If I Believe I No Longer Need a Representative Payee ? You have the right to receive your own Social Security check unless SSA believes you are not capable of managing or directing the management of your money.
To request removal of a rep payee, a beneficiary should contact their local office and explain their goal. They will need to complete the appropriate SSA form, which will ask the beneficiary to explain why they can handle their own benefits.
Generally, it can take a few weeks to several months. Once the SSA receives the completed application and all necessary documentation, it must review the case, conduct any necessary interviews, and decide based on the beneficiarys best interests.
We mail an annual Representative Payee Report to the payees who are required to complete the report. Payees who are under 18 must complete the paper version. Individual payees who are 18 or older can complete it online by logging in to their my Social Security account.
Social Security payee rules can be confusing at the very least. If, for some reason, you wish to remove a representative payee, you must prove that youre mentally and physically able to manage the payments received. This requires filling out the appropriate forms and submitting your application.
