From a legal standpoint, any band can cover a song during a live performance, as a result of blanket licenses obtained and paid for by venue owners to performance rights organizations (PROs) such as SOCAN in Canada and ASCAP or BMI in the United States.
When you record a cover of an existing song, you are effectively using someone elses copyrighted work and they must be compensated for the use when you distribute the recording in physical and/or digital media.
A common misconception in the music industry is that you need to get permission from a copyright owner in order to cover a song. In reality, you can go straight to securing a compulsory mechanical license required by law as part of the 1909 Copyright Act and compensating the rights holder for their work.
What is copyright infringement? As a general matter, copyright infringement occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the permission of the copyright owner.
As noted above, once the songwriter has made an original recording or authorized someone else to make an original recording, they cant prevent others from making a cover version so long as the musician making the cover version gets a mechanical license.
You need a mechanical license from the original writer or publisher to record and release cover songs. However, musicians dont need a license to cover a song live, it is the responsibility of the venue.
