you know chase lawyers weamp;#39;ve gotten a lot of questions about what are called cover recordings now a cover recording is actually a copy of a sound recording that some other artist has been featured on so why is it that thatamp;#39;s not copyright infringement since copyright covers the right to copy the reason is because of section 115 and the United States Copyright Act which provides for whatamp;#39;s called a compulsory license if you want to do a new recording of something thatamp;#39;s already been recorded so you can go ahead and do these freely because of section 115 of the Copyright Act you can go to Harry Fox agency even though these days too easy song licensing and get yourself a piece of paper called a compulsory license which will permit you to make that cover recording and then go ahead and make as many as you like and become a star so if you liked this video hit the thumbs up button below and let us know also you can subscribe to the chase lawyer

Some ways to avoid a copyright violation here include: Create a cover that is transformative. That is to say, youve put such an original, creative spin on the piece of work that no one could confuse it for the original. Use the YouTube search feature before covering a song to check the music rights.
No matter how unique and different your version is, someone else legally owns the song and is therefore entitled to royalties. By requesting a mechanical license, you are ensuring that the original creator of the song is getting their fair share of the sales of the cover.
There are two main ways to obtain song licenses: working directly with the rights owners (the do-it-yourself method) or paying a service to handle the whole thing. Many U.S. publishers use the Harry Fox Agency (HFA) to manage their mechanical licenses and payments.
When you record a cover of an existing song, you are effectively using someone elses copyrighted work and they must be compensated for the use when you distribute the recording in physical and/or digital media.
A new recording of an existing song requires a cover song license, referred to as a compulsory mechanical license. This means that the owner of the songs copyright has an obligation to give you a license. However, this is providing the use of the song falls under a certain set of conditions.
While you own the recording of your cover song, the copyright owner owns the composition and still give permission for the composition to be used in audiovisual media (this is a separate license from the compulsory mechanical license).
When someone records and releases a song, you are free to do your own cover version of that song by obtaining a mechanical or compulsory license. Then, every time your cover version is sold or reproduced, you (or your record label) must pay the statutory royalty fee for that song (currently 9.1 per copy in the US).
Do you get paid royalties for that release? The answer is yes, but some things have to be done first. You as the person making the cover will end up PAYING a mechanical royalty to the artist or songwriter for your cover. There are a number of services you can do this through.
