It is important to note that the effect of a contract does not depend on the name given to it. Many people assume that the tittle of the contract will determine the relationship between the parties however it depends on the manner in which the contract is drawn.
Authorised signatories can sign a contract on behalf of a party. The authorised signatory can be the party themselves (e.g a person), a group of people (e.g. jointly liable tenants) or a signatory of the party where the party is a person (e.g. power of attorney) or a company (e.g. director).
A signatory is a title used to describe someone that has signed or will sign a legal agreement of some kind. Each contract can have multiple signatories, and each will assume the rights and responsibilities outlined in the agreement once it has been signed.
The title should briefly state the overall purpose of the document. Some examples of titles are Sale Agreement, Equipment Transfer. Or Purchase Agreement. The document title should be placed at the top of the document for easy referencing.
Title: This defines what the agreement is about. For example, Lease Agreement. Identity: This section identifies the parties that are agreeing to the terms that will be set. The parties should be identified using their legal names and then after that titles can be assigned to them.
An authorized signatory is a person allowed to act on behalf of your business, and their name is stated in your official business/company records. Sometimes there can be more than one authorized signatory, so two or more persons need to provide their signatures.
This is used to describe someone who is entitled to sign, execute and approve business contracts on behalf of a company. A companys director tends to be the authorized signatory, but this can vary.
