hi its tina and tim again and were on the topic of trial so what were going to do is a couple short questions every attorney in a family court matter or matrimonial the final question they should be asking the person on the stand such as im going to use tim as one of the litigants is what he actually what he wants from the court and what he wants the court to do after trial is over when they make their determination so were going to now pretend that this is a child support modification and tims going to tell the court what he wants the court to do so im going to say my last question so mr sherlock what are you asking the court to do today im asking the court today to please take into consideration and lower my support okay and then i would then ask the court to put in a closing whether its in writing or on the spot im not a fan of on the spot but at least the closings in and youre not worried about doing it at a later date so stay tuned for our next video where were going

Email dcse.cseweb@dfa.state.ny.us with subject Modify Order and request a phone appointment. Include your child support case ID in the email. Visit the OCSS Customer Service Walk-in Center at 151 W. Broadway, 4th floor in Manhattan, open Monday to Friday between 8 am and 6 pm, except on holidays.
You have the right to request a review for a modification if there has been a change in circumstances since the order was entered, or if three years have passed since the order was entered or last reviewed for modification.
For most parents obtaining a new order that modifies your support may take at least 6 months. Please review the modification steps below and quickly respond to any requested information from our office to help speed up the process.
You should ask for a modification if: You are laid off or fired from your job. You get a new or additional job. Your income or the other parents income increases or decreases. Custody or visitation changes.
Parties are free to petition the court for an upward or downward modification of child-support as many times as they wish. However, the parties do run the risk that the court will stop taking them seriously and mandate orders which will preclude litigants if they make applications too frequently.
Either the custodial parent who receives child support can petition Family Court for a modificationusually an increase, or the noncustodial parent who pays child support can petition Family Court for a change--- usually a decrease.
There is no definitive definition of substantial change in circumstances. However, there are at least three good examples of what is a substantial change in circumstances, they are: (i) one or more of the children are now over the age of 21 years of age; and/or (ii) one or more of the children have now changed where
