A participant meets the Rule of 60 if his or her age plus full years of service equal at least 60 and he or she either: (i) is at least age 50 with at least five full years of service; or (ii) is under age 50 with at least 20 full years of service.
The court may correct a clerical mistake or a mistake arising from oversight or omission whenever one is found in a judgment, order, or other part of the record. The court may do so on motion or on its own, with or without notice.
Here are the steps required to designate the record on appeal with the trial court. Step 1: Complete the Notice Designating the Record on Appeal form (unlimited civil cases) Step 2: Serve a copy of the completed form to all parties in the case. Step 3: File the original form and proof of service with the trial court.
Such a motion under Rule 60(b) does not affect the finality of the judgment, but a motion under Rule 59, made within 10 days, does affect finality and the running of the time for appeal.
