A correction deed, also known as a confirmatory or corrective deed, is a legal document used to fix errors on a property title that is recorded.
Perhaps it describes the wrong parcel, or fails to reflect all land purchased in the sale. An error in a legal description of a property has consequences. It can affect taxes. As lenders extend loans based on a percentage of the propertys appraised value, footage mistakes can sink a loan approval.
The State of California allows property owners to correct their deeds using one of two ways: an affidavit or a correction deed.
Title companies will insure/defend against loss with regards to the legal description they insert (since the buyer did not controvert such legal description prior to closing). However, they do not insure that the legal description is correct or fully complete.
If the legal description of the property is listed incorrectly in the sales contract, there can be several risks involved. The buyer may not get the property they intended to purchase, the seller may not have legal ownership, and disputes or legal complications could arise.
Legal disputes: If the legal description of a property is inaccurate, it can lead to legal disputes between the buyer and seller. For example, if the legal description does not accurately reflect the boundaries of the property, it may be unclear who owns certain parts of the land.
Minor errors found in legal descriptions can be corrected by a curative notice recorded in the county public records. The legal description may state northeast when it really should have said north.
A Corrective Deed is used to fix/correct an error on a California deed which has already been recorded. This type of deed does not create a new interest. The Corrective Deed will correct the deed document on the earlier transfer of interest.
