A photography contract is a legally binding agreement between a photographer and their client(s). It defines the rights and obligations of the parties, to include payments, deliverables, schedules, etc. A good contract will also cover copyright, usage rights, limits of liability and more.
Indemnification. The Client will hold harmless and indemnify the Photographer against any and all claims and actions arising out of the activities related to the session, or resulting from the activities during the event, including, but not limited to any related events arising from this Contract.
Here is a list of important items to include in a freelance photographer contract: Description of work. You should have a clear description of the work you will perform and your deliverables. Event date. Number of photos. Pay rate. Time of payment. Spot for a signature.
By including a liability limitation section in your contract, you protect yourself from unexpected occurrences such as natural disasters, or personal illness. Its also a good idea to state in this section if you will provide a replacement photographer in such cases, and/or provide a full or partial refund.
The liability and indemnification section limits your legal responsibility for any damages or losses that may occur during or after the photography project. It also states that the client will indemnify you from any claims or lawsuits that may arise from their use of your photos.
