A patent gives you a legal right to stop others from making, using, or selling something you have invented for up to 20 years. Your rights only exist in the country or region where your patent is granted.
A patent is an exclusive right granted for an invention. In other words, a patent is an exclusive right to a product or a process that generally provides a new way of doing something, or offers a new technical solution to a problem.
The basic elements of a patent application are: The technical specifications, including a summary of the invention, usually accompanied by drawings. One or more claims listed at the end of the specification. An oath or declaration that the inventor was the first to invent the subject matter described in the specification.
So who owns a patent/patent application? In the US, the inventor is presumed to be the initial owner of a patent or patent application. If there is more than one inventor, there may be more than one owner. Ownership can be transferred or reassigned.
The right conferred by the patent grant is the right to exclude others from making, using, offering for sale, or selling the invention in the United States or importing the invention into the United States during the term of the patent.
Whenever a mistake of a clerical or typographical nature, or of minor character, which was not the fault of the Patent and Trademark Office, appears in a patent and a showing has been made that such mistake occurred in good faith, the Director may, upon payment of the required fee, issue a certificate of correction, if
