Your severance agreement may interfere with your future employment if it includes a non-compete provision, non-solicitation clause, clawback provision, cooperation requirement, or other terms.
However, severance packages typically include pay through the termination date and any accrued vacation time, unreimbursed business expenses, and an additional lump sum. By law, employers of a certain size must offer the opportunity to continue health care coverage under the companys plan at the ex-employees expense.
Elements of a severance package that might be up for negotiation: Amount of severance pay. How severance is paid (installments or lump sum) Coverage of healthcare plan costs. Exact date of termination. Vesting in a retirement plan or stock options. Outplacement or job-training services.
A severance clause seeks to ensure that even with the removal of such a clause, the remainder of the contract will survive.
Dear [Employee Name], I regret to inform you that your employment with [Company Name] is terminated effective [date]. Four weeks of severance pay is being offered in exchange for signing the attached release of claims and returning the signed release to human resources no later than [date].
Severance pay is usually based on the number of years youve worked at your employer. Generally, youll get one week to four weeks of pay per year of service, but it is common for employers to pay out two weeks of pay for each year at the company. Of course, every company differs in calculating total severance pay.
As a rule of thumb, severance pay will cover six to 18 months of your salary, and it may also include a vesting schedule for shares. If your previous job had a generous severance package, or complex deferral plans, your lawyer will make sure that your new package matches those benefits or exceeds them.
It is usually based on length of employment for which an employee is eligible upon termination. There is no requirement in the Fair Labor Standards Act (FLSA) for severance pay. Severance pay is a matter of agreement between an employer and an employee (or the employees representative).
For example, a severance contract could include a severance pay term granting one weeks pay for each year of service to the employer. Although not required, some employers may also offer other severance benefits, such as job counseling or payment of COBRA expenses, as part of an overall severance package.
Typical severance packages offer one to two weeks of paid salary per year worked. Continuation of insurance benefits, assistance finding another job, and other perks can be negotiated.
