ugh so many things im not gonna be able to memorize this im gonna have to read off my computer its so confusing hey yall im dr marta perez welcome back to my channel where we discuss pregnancy birth and postpartum today were gonna talk about kind of a slightly different thing were gonna talk about parental leave policies and how confusing they are dont forget to hit subscribe so that you never miss a video [Music] the reason i wanted to make this episode is because i get so many of my patients coming to me with paperwork and questions about when can i take off work what paperwork needs to be done what are my rights during this postpartum period about spending time with my baby so we are going to cover some of that in this episode just a quick note im going to use the term parental leave and mostly what im talking about is maternity leave or leave for a woman who has given birth to a child but i really feel passionate about using the terms parental leave so that we can advoca

When should I take my maternity leave? Some women begin taking their leave a week to a month before the expected birth because of discomfort or the desire for time to prepare. Others wait until the last moment so they can maximize their time with the baby once it arrives.
The ideal length of time to take maternity leave, of course, is up to each individual family. But for what it is worth, the American Academy of Pediatrics and the Pediatric Policy Council both support providing 12 weeks of paid leave.
When should I take my maternity leave? Some women begin taking their leave a week to a month before the expected birth because of discomfort or the desire for time to prepare. Others wait until the last moment so they can maximize their time with the baby once it arrives.
The American College of Obstetricians and Gynecologists (ACOG) recommends women take at least six weeks off work following childbirth.
If you get contractual maternity pay you might only keep your full amount if you return to work. You wont need to pay back statutory maternity pay or Maternity Allowance, even if you dont return to work. Check what type of maternity pay youre entitled to if youre not sure.
So, yes, legally you can quit now; you dont have to wait until you return from FMLA. You also dont have to give two weeks notice. Thats a nice thing to do, but its not required by law, only convention.
You should resign in the normal way, giving the notice period stated in your contract or agreed with your employer. If you resign during your maternity leave, you do not have to go into work during your notice period, you can remain on maternity leave.
Rights to statutory leave and pay If your job ends before this week, you will not be entitled to SMP, but you may be entitled to Maternity Allowance instead. If you resign during maternity leave, and during the 39 week maternity pay period, you will be entitled to be paid any remaining SMP or Maternity Allowance.
