It is a HIPAA violation to email patient names when the sender of an email is a member of a covered entitys or business associates workforce, when the patient names qualify as PHI (because the emails contain health information), when the email is sent for an impermissible purpose, and/or when the emails are sent
If a correction is needed on a patients paper chart, a single line needs to be made through the incorrect portion and then the person making the correction needs to date, time and initial it. The correction is typically made above the incorrect portion.
After you find errors in your medical records, you need to request that those mistakes are corrected. Most hospitals, medical offices, or other healthcare providers will have a form to fill out, but others may require a written letter. When detailing the errors you found, be as clear and concise as possible.
The HIPAA Security Rule does not require emails to be encrypted, but makes it an addressable implementation specification, because alternative technologies exist (i.e., key-agreement algorithms) that can be equally as effective as encryption for protecting PHI at rest and in transit.
If the email correspondence is related to the patients care, it should generally be included in the medical record.
Ensure you have end-to-end encryption for email To make your email HIPAA compliant you should ensure you have end-to-end encryption, which encrypts both messages in transit and stored messages. Encryption controls ensure only the intended recipient and authorized personnel can access the messages.
HIPAA Violation Email Example Failing to use an email encryption service. Not having patient authorization for email communications, but sending them an email anyway. Including PHI in the subject line of your email. Sending an email with PHI to the wrong patient.
