If your business or organization sends commercial electronic messages (CEMs), such as emails promoting a product or service, you must comply with CASLs Footnote 1 requirements to: obtain consent, provide identification information, and include an unsubscribe mechanism in each message.
Under CASL, consent is required before sending a CEM. Yet, an electronic message that is sent to obtain consent to send a message for commercial purposes is also considered a CEM. Consent can either be express or implied. Express consent means someone actively gave you permission to send him/her a CEM.
An agreement between two entities licensing one party to develop and commercialize one or more pharmaceutical products incorporating the other partys proprietary active ingredient and related patentable technology, know-how, or other intellectual property (IP).
Consent. There are three general requirements for sending a commercial electronic message (CEM) to an electronic address: (1) obtain consent, (2) provide identification information, and (3) provide an unsubscribe mechanism. There are two types of consent under CASL express and implied.
Heres a rundown of CAN-SPAMs main requirements: Dont use false or misleading header information. Dont use deceptive subject lines. Identify the message as an ad. Tell recipients where youre located. Tell recipients how to opt out of receiving future marketing email from you.
In order to send CEMs legally, the sender must first obtain consent from the recipient. Consent can be obtained directly, called express consent, through an opt-in; or indirectly, through implied consent. Express consent means that a person has clearly agreed, either orally or in writing, to receive a CEM.
Commercial Electronic Message (CEM) A CEM is a message sent by an electronic means, such as an email, instant message, tweet, voicemail, or text to another electronic address with, as its purpose or as one of its purposes, to encourage participation in a commercial activity.
