Minors (those under the age of 18, in most states) lack the capacity to make a contract. So a minor who signs a contract can either honor the deal or void the contract. There are a few exceptions, however. For example, in most states, a minor cannot void a contract for necessities like food, clothing, and lodging.
In general, the legal contract age is the states age of majority. The age of majority is the age when a person is considered an adult. For most states, this is 18 years of age. The age of majority may vary ing to state laws, however.
Minors dont have contractual capacity, and the laws that define the age of contractual capacity (and maturity) are created to protect them. In most countries, minors generally cannot sign a contract that will be upheld in court. In other words, that contract would be voidable.
In most cases, this means that the individual must docHub the age of majority before they can enter into contracts. However, all states have laws that set the age at which individuals docHub legal capacity and the age at which they may undertake certain legal actions.
If legal capacity is lacking, the contract is void. Lack of legal capacity unfolds in various scenarios: Minors and Contracts: Contracts entered into by minors or underage individuals below the age of majority (typically 18 years old), are usually considered voidable.
Because of that, when minors sign contracts, the contract is not valid, and minors are under no obligation to honor that contract. There are exceptions, which include contracts for food, lodging, medicine, and other necessities.
In cases of minors lying or using a false identity, whether in words or in writing, to get into contracts, the minor would be fully obligated to the contracts terms. A minor has the right to cancel a contract by asking the court to void it or by pleading the defense of lack of contractual capacity after being sued.
In practice, the age of the majority is usually 18. Contractual capacity, or the capacity to contract, is the ability of a person to enter into a contract and therefore also refers to their responsibility to meet the obligations stated in it.
