Technically, the Bankruptcy Code does not require you to be of a certain age to file bankruptcy. However, different states may have age requirements for how old you have to be to begin building credit or sign contractual agreements. In many states, this means you must be at least 18 years of age to file bankruptcy.
You must reside in Canada, do business here or at least own Canadian property. You must owe at least $1,000. You must be unable to meet the payment requirements of your debts as they come due. Your debts must exceed the total value of your assets.
To be eligible to file bankruptcy in Canada you must be an insolvent person which means you: owe at least $1,000 in unsecured debt, are unable to pay your debts as they come due or. you owe more in debts than the value of the assets you own, and. you must either reside, do business, or have property in Canada.
The average of your monthly income in the previous six months must be lower than the median income for the same-sized household in your state; otherwise, you must pass whats known as a means test. This test determines whether your disposable income is high enough to make partial payments to unsecured creditors.
Can I be denied personal bankruptcy in Canada? A Licensed Insolvency Trustee (LIT) may refuse to accept your application for bankruptcy if you are unable to cover the Trustees fees. If you cant find LITs to accept your bankruptcy application, the OSBs Bankruptcy Assistance Program may be able to help you.

The law states that credit reporting agencies may not report a bankruptcy case on a persons credit report after ten (10) years from the date the bankruptcy case is filed. Generally, bad credit information is removed after seven (7) years.

You can keep enough food to support you and your dependents for up to 12 months. You can retain up to $4,000 in home furnishings and appliances. All medical and dental aids are exempt.
