A partnership generally cannot have a tax year other than its majority-interest tax year ( Code Sec. 706(b); Reg. 1.706-1). This is the tax year that, on each testing day, constitutes the tax year of one or more partners having an aggregate interest in partnership profits and capital of more than 50 percent.
