Who is a copyright owner? Everyone is a copyright owner. Once you create an original work and fix it, like taking a photograph, writing a poem or blog, or recording a new song, you are the author and the owner. Companies, organizations, and other people besides the works creator can also be copyright owners.
A Copyright Transfer Agreement (CTA), or any other intellectual property transfers, must be submitted to the U.S. Copyright Office to be examined and officially recorded. The document stating the transfer must be signed by the copyright owner or the copyright owners patent lawyer to be considered valid.
Co-authors own the works copyright jointly and equally, unless the authors make an agreement otherwise. Each joint author has the right to exercise any or all of the exclusive rights inherent in the joint work.
Although EULAs vary, every EULA should include clauses explaining: The enactment date. The binding nature of the agreement. Your contact details and full business name designation. The governing laws. Permitted and restricted uses. Termination conditions. Warranties and limitation of liability. Related agreements.
How to create a copyright license agreement The names of the parties and the description and name of the licensed work: Write out the full legal names of the parties to the agreement. The name(s) and description(s) of the work(s) being licensed: List out the work or the works youre licensing to the licensee.
Your Legal Rights As a Joint Author If you are a joint author, you hold an equal interest in the copyright with the other authors regardless of your actual contribution to the work. Technically speaking, you hold an undivided ownership share in the copyright.
The other owners technically cannot sue them for copyright infringement, because an owner cannot infringe on his own work. As a joint author and co-owner, they would have to sue for accounting, not for infringement. As stated above, joint copyright owners have an obligation to account proofits to the other co-owner(s).
