A landlord must serve the Two Month Notice to End Tenancy so that its received: At least two months before the effective date of the notice, and. Before the day that rent is due.
Only a few states regard texting as legal written notice, and none regard them as legal documents. There are times when a text is considered to be a written notice, and it may be legally binding on occasion. However, texted material cannot be used as a technical written document.
You can oppose your eviction even if you havent paid your rent. Without opposing the eviction the court is likely to grant whatever the landlord is asking for, as long as it is lawful.
A tenant can be evicted within ten days if they miss a payment. Depending on the reason for eviction, the landlord needs to provide 10 - 120 days of notice. Tenants have a ranging window to dispute the eviction with the Residential Tenancy Branch (RTB).
Tenants who disagree with a notice need to apply for dispute resolution writing a letter or talking to the landlord isnt enough. Submit a tenants application for dispute resolution along with a copy of the Notice to End Tenancy.
If you do not leave at the end of the notice period, your landlord must apply to the court for a possession order. If the court gives them a possession order and you still do not leave, they must apply for a warrant for possession - this means bailiffs can evict you from the property.
Tips for Renting After Eviction Understand your situation. Talk to your previous landlord. Try an apartment locator. Find a landlord that doesnt do background checks. Get references. Seek a co-signer. Stay on top of your credit. Be honest.
Proper notice is required in written form, to the end of the term or lease, giving a notice period of at least 60 days. Text communication would not be deemed legal notice.
Once the review period is finished and the Order of Possession has not been suspended, a landlord can apply to the Supreme Court of British Columbia to get a Writ of Possession. This authorizes the landlord to hire a court bailiff.
However, it is likely that a text message or email would also meet the requirement for a notice to be in writing.
