The reason mothers win the majority of custody battles is because they have been the primary and sometimes the only caregivers the children have ever known.
The other parent may or may not have rights of access and rights of decision making. When the other parent has rights of decision making, this is called joint legal custody. Sole maternal custody is the norm in Canada and most other countries for which there are data.
Almost 7 percent were placed in their fathers custody, and for 13 percent of children, a shared custody arrangement was established. These proportions change ing to the age of the children at the time of separation.
However, there is no set guidelines for reasonable access for father. Each family is unique and reasonable access for fathers depends on the individual circumstances. Some fathers see their children every day, while others might see them just once a month.
Common types of custody arrangements include: Sole Custody. When a parent receives sole legal custody, they will have the exclusive ability to decide how to raise the child. Joint Custody. In a joint custody arrangement, both parents have custody rights to the child. Split Custody.
The Supreme Court of Canada has determined that a custodial parent cannot automatically move a child anywhere without the other parents consent. Similarly, the Ontario Court of Appeal has also decided that a custodial parent does not have an inherent right to move a child anywhere he or she decides.
Close to 80 percent of children under the age of 12 were placed in their mothers custody in cases where a court order existed. Almost 7 percent were placed in their fathers custody, and for 13 percent of children, a shared custody arrangement was established.
