Selling products with brand logos can get you in big trouble. Its considered trademark counterfeiting and is illegal. Brand logos are protected intellectual property.
If you have not yet sold any good or services under your desired mark, then an ITU application can provide docHub benefits. By filing an Intent-To-Use application, you get an earlier filing date even though you havent launched the product or made any sales.
Use-based applications are freely asdocHub; ITU applications are not. An ITU application can only be assigned to a successor to the business, or a portion of the business to which the mark pertains, and only if that business is ongoing and existing.
A trademark owner who believes its mark is being infringed may file a civil action (i.e., lawsuit) in either state court or federal court for trademark infringement, depending on the circumstances. However, in most cases, trademark owners choose to sue for infringement in federal court.
If you have not used your mark in commerce yet, but have a good faith intention to do so in the future, you can file an application to register your trademark or service mark with an intent-to-use (ITU) filing basis.
When you use someones mark without their permission in a way that infringes on or dilutes their mark, then your use is usually unlawful. The trademark owner can normally sue you to stop you from using their mark, and they can collect money damages.
Would modifying a logo make it legal to use? Logos are protected by trademark and copyright. If you modify someone elses logo for your own use, the modifications must be docHub enough so that no reasonable person could confuse your logo for the original logo.
The 20 Percent Rule If youre interested in trademarks and design, you may have heard that you only need to alter a logo by about 20 to 25 percent in order to claim it as your own. It can be inspired by a logo that already exists and is in use as long as it differs enough that it appears to be its own design.
