For a deed to be legal it must state the name of the buyer and the seller, describe the property that is being transferred, and include the signature of the party that is transferring the property.
Documentary stamp tax is payable by any of the parties to a taxable transaction. If one party is exempt, the tax is required of the nonexempt party.
In Florida, no documentary stamp tax is owed on this type of transfer if (a) no money or other consideration is given in exchange for the property and (b) there is no mortgage on the property. Otherwise, the documentary stamp tax will apply to the unpaid balance of the mortgage or value given for the property.
Nebraska requires the new owner to complete and submit to the register of deeds a Form 521 Real Estate Transfer Statement. This form is due when filing a deed for recording. It provides details about the transfer and must be signed by the new owner or an authorized agent.
Sellers are typically responsible for paying the Florida Documentary Stamp Tax on the deed, while buyers who are financing usually foot the stamp tax bill on the mortgage itself.
Regardless of where the deed or other document is signed and delivered, documentary stamp tax is due. The amount of tax due is computed based on the consideration for the transfer. All parties to the document are liable for the tax regardless of which party agrees to pay the tax.
A Quit Claim Deed is required to clearly identify the grantor and grantee, the address of the property being transferred, a legal description of the property, the manner in which the grantee is taking title, a docHubd signature of the grantor, and the name and address of the party that has prepared the deed.
The three most common Nebraska deed forms for transferring real estate ownership from its current owner (the grantor) to a new owner (the grantee) are warranty deeds, special warranty deeds, and quitclaim deeds.
NOTE: All deeds must contain a full, current legal description of the property, name of the party transferring the property (grantor), name of the party receiving the property (grantee) and must be signed by grantor(s) and docHubd.
As provided in Section 5(c) of the Act, the IA shall pay for account of the seller/owner, the Capital Gains Tax (CGT), as well as the Documentary Stamp Tax (DST), transfer tax and registration fees, while the owner shall pay any unpaid real property tax.
