Under general copyright principals, a copyright becomes the property of the author who created the work. However, work for hire is an exception to this principle, and can be established through contract before a particular work is created.
1 For legal purposes, when a work is a work made for hire, the author is not the individual who actually created the work. Instead, the party that hired the individual is considered both the author and the copyright owner of the work.
If what youve made is a work made for hire, you cant stop them from using what youve made. If, on the other hand, youve promised to assign the copyright once theyve paid you in full, you can stop them from using what you made. They dont own it yet, you do. If they want to own it and use it, they need to pay you.
Copyrights are generally owned by the people who create the works of expression, with some important exceptions: If a work is created by an employee in the course of his or her employment, the employer owns the copyright.
There is no provision in Canadian copyright law that corresponds to the work made for hire doctrine in United States law. Therefore, unless an author of a work makes an assignment in writing of the copyright in the work to the person who commissions that work, the author owns copyright in the work.
Pursuant to subsection 13(3) of the Canadian Copyright Act, R.S., 1985, c. C-42, where an employee, creates an original work in the course of employment and in the absence of any agreement to the contrary, the employer shall be the first owner of copyright.
the work must be specially ordered or commissioned; there must be a written agreement between the parties specifying that the work is a work made for hire by use of the phrase work for hire or work made for hire.
The rules for ownership of IP depend on the type of IP: For copyright, in most circumstances, an employer is deemed to own a work created by an employee, but an independent contractor or service provider is deemed to own a work that it creates (subject to an override in a written contract)
