The original is always best. In law we have something called the best evidence rule. Basically, if you are presenting evidence to a court, it must be the best evidence available. So if a signed agreement is evidence, then the agreement with the original signatures of both parties will be the best evidence.
When it comes to legal documents, the original signed copy is always the preferred form of evidence. This is due to the fact that its harder to dispute the authenticity of an original document compared to a copy, digital image, or photocopy.
When an individual executes a deed, their signature must be witnessed. A party to a deed cannot be a witness to another signature to that deed.
Generally, a copied signature isnt legally binding.
All that needs to be is some mark that represents you. It can be a series of squiggles, a picture, or even the traditional X for people who cant read and write. As long as it records the intent of the parties involved in a contractual agreement, its a valid signature.
A signature can be rendered invalid if it is not consistent throughout the document. This includes instances where different pens are used for signing and witnessing a legal document. Even if all other aspects are flawless, the use of different pen colours or types would render the document invalid.
Each party should get an original signed copy of the contract for their files. That means if there are two parties to the contract, two identical contracts must be signed. One original copy of the contract should go to you, and one original copy should go to the other party.
