An employer that participates in E-Verify MUST NOT: Use E-Verify to discriminate against you on the basis of your citizenship, immigration status, race, color, religion, sex (including pregnancy), gender identity, and sexual orientation, national origin, age (40 or older), disability, or genetic information.
Do not compare the photo displayed by E-Verify to the actual employee. Employers should have directly compared the photo on the document to the employee during Form I-9 completion and prior to creating the E-Verify case. Photo Matching - Process Overview provides a summary.
Employers participating in E-Verify are required to retain a copy of certain documents if the employee chooses to present them. These documents include the U.S. Passport, passport card, Permanent Resident Card (also called a Green Card), or Employment Authorization Document (EAD).
For most documents presented, E-Verify requests an image of both the front and back. If you are entering a U.S. passport or passport card, E-Verify will request an image of the Passport ID page and the Passport Barcode page.
Photo matching only occurs when the employee chooses to present any of the following: A Permanent Resident Card (Form I-551) Employment Authorization Document (Form I-766) A valid U.S. Passport or U.S. Passport Card.
Compare the photo displayed in E-Verify with the employees Form I-9 photo document or copy of the document and determine if the photos are reasonably identical. The photos should be identical with only minor variations in shading and detail between the two photos.
What must an employer and employer agent do to ensure employees are treated equally and fairly when using E-Verify? Answer: Create a case in E-Verify only AFTER the applicant accepted an offer of employment and Form I-9, Employment Eligibility Verification is complete.
Should employers keep copies of the documents employees provide for Form I-9 purposes? If an employer does not participate in E-Verify, there is no requirement to make copies of documents.
