Dr. Ira Byock from Dartmouth-Hitchcock Medical Center discusses the importance of advanced directives for adult patients. He explains that these documents outline how individuals want their medical treatment decisions made in the event of a life-threatening condition, including who should advocate for them and what treatments they wish to receive or refuse. Dr. Byock aims to dispel misconceptions, noting that conversations about advanced directives do not imply a serious condition. Instead, these directives ensure that patients’ preferences are respected, providing peace of mind for both patients and their families. He encourages everyone to have an advanced directive on file in their medical records.

Living will is actually an American term. In British Columbia, we use advance directives and substitute decision-making agreements like representation agreements to achieve similar goals.
A power of attorney only allows you to have someone make financial and legal decisions for you. A representation agreement allows someone to help you make personal and healthcare decisions. They can help you make these while youre healthy or make them for you if you become unable to do so.
A representation agreement permits you to designate one or more persons to make healthcare decisions on your behalf. This type of agreement covers a wider range of circumstances than advance directives and allows you to authorize one or more representatives to act on your behalf.
Advance directives are legal documents that provide instructions for medical care and only go into effect if you cannot communicate your own wishes. The two most common advance directives for health care are the living will and the durable power of attorney for health care.
Representation Agreements differ from Advance Directives because they cover a broader variety of circumstances and they bind one or more representatives to act on your behalf.
A Representation Agreement is made between a person and a representative or series of representatives which sets out in written form how health care and financial decisions are to be made for that person in the event of incapacity.
Living Wills typically only state end-of-life wishes and are considered by some to be only morally binding documents in BC. Representation Agreements are legally binding on the representatives, and authorize them to make most personal and healthcare decisions on your behalf.
It is a good idea to make an advance directive while you are well. You could become incompetent or unable to speak suddenly, for example, if you were in a serious car accident. Canadian courts have said that doctors and other health care providers must respect valid advance directives.
