In a land lease, the dwelling is owned by the resident and the land on which the dwelling sits is leased. Life lease ownership means holding an interest in property providing the right to live in the unit, usually for the duration of the lease holders life or until the lease holder decides to move.
Several types of leases are available on public land. The rent is calculated ing to the intended use of the lot, and leasing costs will vary. For each leasing agreement, the lessee is granted the right to use the lot on certain conditions.
Apart from these two types of ownership structures, there is another lesser known way of owning, which is known as leasehold ownership. In this kind of an ownership, the resident owns the house, but leases the land on which it sits. In Alberta, apart from housing, land is commonly leased for agriculture and grazing.
This is known as a leasehold title and is registered against the landlords interest in the property, which becomes subject to the leaseholders interest for the period of the lease, generally preventing the landlord from doing anything with the property without the leaseholders consent.
With a leased-land property, you risk losing all of your equity at lease expiration, depending on the terms of the surrender clause. The resale of the home is likely to be more difficult than the resale of a traditional home, especially because with each passing year, the remaining term on the lease shortens.
Any changes to the lease should be initialed by both parties. New York City rent stabilized tenants are entitled to receive a fully executed copy of their signed lease from their landlords within 30 days of the landlords receipt of the lease signed by the tenant. The leases beginning and ending dates must be stated.
This is because the purchase price of land lease homes is lower. The same principle applies to the tax you will be paying. Property taxes are lower for land lease homes compared to traditional homes because you need to pay tax only on the home.
With a leasehold property, you own the structure but not the land. The owner of such land is usually the government or a First Nations group. With this arrangement, you lease the land from the owner for a certain amount of time, usually 99 years. Though lease terms can range anywhere from 40 to 999 years.
