Landlords are required to give official notices of eviction which starts the eviction process. However, a tenant does not have to do anything until the landlord files an eviction application with the Landlord and Tenant Board (LTB). The LTB will notify a tenant of the application and hearing date if/when this happens.
You will then have to act very quickly to try to stop the eviction. You must file a Motion to Set Aside an Ex Parte Order with the Board as soon as possible. But to be safer, you must do this within 10 days after the date of the order. You can get forms for filing this motion from the Board.
Landlords are required to give their tenant at least 60 days written notice to the end of the term or rent period using the Landlord and Tenant Board Form N12.
If the landlord gives a tenant notice to end the tenancy and the tenant does not move out, the landlord can apply to the LTB for an order evicting the tenant. The tenant has the right to go to a hearing and explain why they should not be evicted or ask for more time to move out.
Standard orders mean tenants have 11 days to pay back all arrears. If the tenant doesnt pay back every last penny of their arrears (partial payment doesnt hold any weight), the landlord can immediately file with the sheriff.
Landlords can end tenancies early, with a general rule of at least 10 days notice for most situations, for the following reasons: Repeatedly not paying rent or paying rent late. Disturbing others enjoyment of the property or posing a safety threat. Damage to the property or bdocHubes of the rental agreement.
The Fastest Way to Evict a Tenant in Ontario It is much faster to agree to pay the tenant 1-2 months rent in exchange for leaving at the end of the current month. If the tenant fails to correct the problem or move out, the landlord can ask the Board to terminate the tenancy.
How Long Does It Take to Evict a Tenant in Ontario? Unfortunately, eviction is not a speedy process. It can take anywhere from 85 138 days to evict a tenant after an eviction notice has been given. If the tenant needs to be removed by the Sheriffs office, the timeline could stretch to 168 days.
