For example, a contractor is required to be licensed in New York. If the contractor is not licensed, they cannot file a mechanics lien against a property. The same goes for tradespeople. If the work requires a licensed plumber, and the person who performed the work was unlicensed, they cannot file a lien.
The filing fee is $35.00. A Notice of Mechanics Lien may be filed against a property for non payment of funds, for work performed or materials furnished. Liens must include the propertys block and lot numbers. Mechanics Lien must comply with all requirements found in sections 9 and 10 of the New York State Lien Law.
This form advises the party that a lien will be filed if payment is not received within 10 days. Since this is a non required document, you can deliver it electronically, or via mail. Sendinging documents via certified mail always adds another layer of professionalism to your payment practices.
The mechanics lien remains valid for one year provided the affidavit of service of lien is properly completed and filed. The one year time period is measured from filing in the County Clerks Office.
Mechanics liens expire unless you file a lawsuit to enforce your Lien within 90 days of when the lien was recorded. Just recording a lien does not get you paid, if you do not sue to collect on it in 90 days. This is known as perfecting your lien.
New York Lien Law 20 provides that an owner may discharge a mechanics lien by the payment of money into court. Before a lien foreclosure action is commenced, the discharge is effectuated by depositing with the county clerk a payment equal to the amount claimed in the lien, with interest to the time of the deposit.
PREPARING THE VIRGINIA MECHANICS LIEN Every mechanics lien typically must contain the owners name, a general description of the property and location, the name of the hiring party, the first and last date of work a description of the work performed, and the amount of money owed.
A mechanics lien is a hold against your property, filed by an unpaid contractor, subcontractor, laborer, or material supplier, and is recorded with the county recorders office. If unpaid, it allows a foreclosure action, forcing the sale of the property in lieu of compensation.
