For example, a sentence comparing glass fragments from a suspect's jeans to those from a crime scene is an instance of scientific language that, while effective for scientists, can be difficult for non-experts to grasp. The Best Evidence Rule is applicable only to documents. When the subject of inquiry is the contents of a document, no evidence shall be admissible other than the original writing itself.
All Originals Lost or Destroyed: If all the originals are lost or destroyed, and not by the party acting in bad faith, other evidence of the content is admissible. This acknowledges situations where the original cannot be produced due to circumstances beyond the control of the party seeking to introduce the evidence.
Conversely, if you were trying to prove the contents of a writing recording or photograph and do not offer an original, or in most cases, an exact duplicate in evidence, then youre violating the best evidence rule.
Other considerations: You should not copy works intended to be consumable in the course of study or teaching. These include workbooks, exercises, standardized tests and test booklets, and answer sheets. Copying should not substitute for the purchase of books or periodicals.
The Fair Use doctrine allows you to copy copyrighted material and prepare a derivative work without the copyright owners permission. The doctrine permits the use of copyrighted material in a reasonable manner without consent. Teaching, scholarship, and research are deemed reasonable.
Rule 1004 provides four such exceptions, allowing other evidence of the contents if the original is: (i) lost or destroyed; (ii) not obtainable; (iii) in possession of the opponent; or (iv) a collateral matter.
The primary role of the BER is merely to be an adjunct to authenticity that assures the court that the document is the same as the one inputted into the computer. The rule excludes inferior evidence when better is available and permit inferior evidence when better is not available.
[9] For example, if a plaintiff states in a deposition that he took a photograph prior to an accident showing damage to his vehicle, the opposing party can use the contents from that deposition against the plaintiff to prove that the photograph showed pre-existing damage.
