Telecommuting Act This Act protects the rights and promotes the welfare of the workers under the Telecommuting program, an alternative work arrangement that allows an employee in the private sector to work in an alternative workplace using telecommunication and computer technologies.
The Telecommuting Act, officially known as Republic Act No. 11165 or the Work From Home Law, was introduced to legally establish telecommuting as an approved work arrangement for private employees in the Philippines.
Telecommuting is a voluntary work arrangement in which an eligible employee with approval works one or more days each work week from home instead of commuting to a work place. Telecommuting is generally not intended for situations involving employees who work from home on a full-time basis.
Telecommuting Policy and Procedure.  Objective. Telecommuting allows employees to work at home, on the road or in a satellite location for all or part of their workweek. [Company Name] considers telecommuting to be a viable, flexible work option when both the employee and the job are suited to such an arrangement.
Employers in the Philippines must treat telecommuters fairly regarding their working hours, rest time, overtime, leave entitlement, pay and access to training opportunities, under a law effective 26 Jan 2019. These employees must also enjoy the same collective bargaining rights as employees who work on site.
Either an employee or a supervisor can suggest telecommuting as a possible work arrangement. Any telecommuting arrangement made will be on a trial basis for the first three months and may be discontinued at will and at any time at the request of either the telecommuter or the organization.
The Telecommuting Act In 2019, the Philippine Congress enacted the first legislation recognizing telecommuting or working from an alternative workplace with the use of telecommunication and/or computer technologies or Republic Act No. 11165, otherwise known as the Telecommuting Act.
